Terms, acceptable use, and privacy

The agreement that governs your use of SmmPanelUS, the rules for acceptable use, and how we handle your data. These three documents work together; the Terms of Service govern.

1About These Terms

These Terms of Service ("Terms") govern your access to and use of SmmPanelUS (the "Service," "Site"), available at smmpanelus.com. The Service is operated by its operating entity (the "Operator," "we," "us"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Operator's legal and registration details are not published on the storefront and are available on request to a legitimate party (see Entity & Compliance).

SmmPanelUS is an independent platform operating its own catalog of tools. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to any social network or third-party platform referenced in our catalog. We name third-party platforms only to describe what a tool is for ("Tool for Telegram"), not to claim partnership; how and on what basis we use those names is set out in Use of Third-Party Platform Names.

SmmPanelUS has operated publicly since 2021.

These Terms govern. Nothing said by support or any representative — in a ticket or anywhere else, including on any third-party platform or channel — overrides or adds to these Terms. Such communications are operational help only and carry no contractual weight above these Terms. Only the current published Terms govern your relationship with us.

These Terms are the source of truth. Any other material — pages of the Site, FAQ, blog posts, help articles, marketing, social media, forum posts, third-party listings, search-engine snippets, cached or archived copies, or any other content online — is informational only. It is not a statement of the binding terms and does not override these Terms. Such material may be out of date, may not be under our control, and may remain unchanged for a long time; it does not rank above these Terms. Where any such material differs from these Terms, these Terms prevail, and all conditions that bind you and us are those set out in these Terms (together with the policies they incorporate). This does not change the role of the live catalog at the moment you place an Order: the price, quantity, and limits shown there at order time are the operative figures for that Order, as set out in The Service and Pricing & Currency.

2Eligibility

You must be at least 18 years old to create an account or use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

We do not knowingly permit use of the Service by anyone under 18. We may request proof of age where we have reason to doubt eligibility, and if we become aware of an account belonging to a person under 18, we may suspend or terminate it.

3Your Account

  • You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
  • You are responsible for all activity that occurs under your account.
  • We will never message you first asking for your password, a verification code, or payment details. Always sign in only at smmpanelus.com.
  • Notify us immediately via a support ticket if you suspect unauthorized access to your account.
  • One account per person/entity, except for the resellers and agencies covered in the Multi-Account Policy below. We may suspend duplicate or fraudulent accounts.

4Multi-Account Policy (Resellers & Agencies)

The one-account rule in the section above has a defined exception for legitimate business use.

  • Eligible categories. Resellers, advertising/SMM agencies, and official partners may operate multiple accounts where this is operationally necessary to segment client budgets, projects, or reporting.
  • Up to 10 accounts. Eligible users may create up to 10 accounts without prior notice. Creating them is your representation that you fall into an eligible category and are using the accounts only for legitimate segmentation.
  • More than 10 accounts. Open a support ticket describing the business need before creating additional accounts. We may request more information or decline further expansion at our discretion.
  • Prohibited use. Creating multiple accounts to claim duplicate bonuses, promo codes, or referral rewards (including self-referrals) is not a legitimate business use and is a violation of these Terms. We determine, at our sole discretion, whether multi-account use is legitimate; balances tied to accounts created for promotional abuse may be forfeited under Account Suspension & Termination.

Resellers and child panels. If you resell access or run a child panel built on our API, you do so as an independent operator under your own Terms. We have no contractual relationship with your end customers and provide the Service only to you. You are solely responsible for your customers, your own pricing and terms, and any dispute, refund, or chargeback they raise — those remain your responsibility, not ours. You must maintain your own terms with your customers that, at minimum, disclaim guaranteed outcomes and set your own refund and chargeback rules; you remain solely responsible for honouring them.

5The Service

SmmPanelUS provides access to a catalog of tools ("tools") that customers order and pay for individually. Tool availability, pricing, and limits are shown live in the catalog at the time of order and may change without prior notice.

We do not act as, and do not represent ourselves as, a provider, supplier, reseller, or middleman. We do not disclose or discuss the operational mechanics behind tool delivery.

We do not guarantee outcomes. We do not promise specific results, engagement levels, follower retention, or platform-side behavior of any third-party network. Tools are delivered as described in the catalog at the time of order; figures and limits shown in the catalog at order time are the operative terms for that Order.

You are solely responsible for ensuring that your use of any tool complies with the terms of service, community guidelines, and applicable rules of the third-party platform you are using it on. We are not responsible for any action a third-party platform takes against your account, content, or presence as a result of your use of our tools.

You place your own Orders. All Orders are created by you through the Service — the New Order, Mass Order, or API functions. We do not place Orders on your behalf, and we do not take Orders through social networks, messengers, or any channel outside the Service. We do not control the targets, links, or quantities you choose, and we are not responsible for your choices or actions.

We are not bound by third-party platform rules. SmmPanelUS operates under its own Terms. We are not governed by the rules of any social network or third-party platform. Compliance with those platforms' rules, for the targets you choose, is your responsibility alone.

Drip-feed. Where a tool offers drip-feed, delivery is spread into portions over the interval you set. Each portion is delivered in sequence; you can stop a drip-feed only for portions not yet delivered, and delivered portions are final. Partial outcomes are handled under the Partial completion rule.

Subscriptions and recurring orders. Where a tool offers a subscription or recurring Order, it runs on the schedule you set until you cancel it. You are responsible for cancelling before the next cycle. A cycle that cannot be funded from your Deposited Funds may be skipped or paused; we are not obligated to retry it.

Pricing errors. If a tool is displayed with an obvious pricing error (for example, a price far below its normal level due to a feed or system error), we may cancel any affected Order and return the amount to your Deposited Funds, even after the Order was placed.

Beta tools. A tool marked as beta or experimental is provided as is, without claim eligibility or refill, while in that status.

6Definitions

In these Terms, the following terms have the meanings below, however they may be labelled in the interface:

Interpretation. These defined terms are identified by their function, logic, and the page or feature they refer to — not by an exact wording match. Where the Service, the interface, a page, an email, or a tool uses a different word, label, spelling, abbreviation, or translation for the same thing, the term in these Terms still applies, because it carries identical logic or points to the identical page or feature. A difference in naming alone does not make a provision inapplicable, and no party may argue that a term does not apply merely because the interface names it differently. Examples given for any term are illustrative, not exhaustive. Headings and labels are for convenience and do not narrow a term's meaning. Where a label is genuinely ambiguous, it is read in the way most consistent with the rest of these Terms.

  • Order — your instruction to deliver a specific tool, submitted through the Service with the required parameters (link, quantity). Placing an Order is your acceptance of the tool's description and these Terms. An Order becomes irrevocable once it enters an active status (see Order Status); before that, cancellation may be possible but is not guaranteed (see Orders, Payment & Balance).
  • Balance — the single pool of funds on your account, shown in your balance history (see the Add Funds page). Your Balance is made up of Deposited Funds and Promotional Credit, which are not separate wallets but are distinguished by the funding method recorded for each top-up in your balance history.
  • Deposited Funds — amounts you added yourself by real payment. These are the only funds eligible for withdrawal or a refund to a payment method.
  • Promotional Credit — amounts credited by us through a promotional or bonus method (for example, test credit, a top-up percentage, a promo code, or an individual support grant), identifiable by the funding method in your balance history. Promotional Credit has no cash value and is never withdrawable or refundable, even though it sits in the same Balance.
  • Order Status — the state assigned to an Order by the Service. Key statuses: Pending (received, not yet started); In Progress / Processing (an active status — being delivered); Completed (delivered; final); Partial (some delivered, the rest not); Canceled (not delivered; the amount is returned to your Balance as described in Orders, Payment & Balance).
  • Start Count — the value of the relevant Metric at the moment the Order starts, as recorded by the Service. It is the reference point for delivery and for any refill.
  • Metrics — quantitative figures on a third-party platform page (e.g., followers, likes, views, comments).
  • Drops — a decrease in Metrics on the target page after Order Completion, caused by the third-party platform's own systems or algorithms.
  • Refill — an optional, conditional offer to partially restore Drops, available only for specifically marked tools while their refill option is active. A refill is a goodwill option, not an obligation (see Refill & Guarantee).
  • Order Completion — the point at which an Order reaches Completed status. This is the final confirmation that our obligation for that Order has been met. Subsequent Drops do not affect the status of a completed Order.

7Claim Window

You must report any issue with an Order — non-delivery, incorrect quantity, or a discrepancy with the tool's description — within 3 days of the Order reaching "Completed" or "Partial" status. Claims submitted after this window will not be accepted, except where applicable law requires otherwise. We encourage checking your Order promptly after completion.

8Pricing & Currency

All prices on the Service are listed and charged in US Dollars (USD). Prices may change at any time without prior notice; the price shown in the catalog at the moment you place an Order is the price for that Order. We may modify, replace with an equivalent or comparable alternative, or discontinue any tool at any time without prior notice. Your disagreement with a replacement is not grounds for a refund. You are responsible for any currency conversion fees or charges applied by your bank or payment provider.

9Orders, Payment & Balance

  • To place an Order, you add funds to your Balance. Funds you pay in yourself are your Deposited Funds; you pay for tools from your Balance.
  • Your Deposited Funds are yours and may be spent only on Orders you place yourself. Promotional Credit is governed by the Promotions & Credit section.
  • We accept payment through the methods available on the Site at the time of your transaction.

Order finality. Once an Order enters an active status (In Progress / Processing), it cannot be cancelled, and the funds charged for it are treated as used. A Completed Order is final.

Order cancellation. Before an Order enters an active status, cancellation may be possible — through the cancel option on the Order's page in your account or by contacting support — but is not guaranteed. We do not promise that any specific Order can be cancelled.

Partial completion. If an Order ends in Partial status, the amount for the undelivered portion is returned to your Balance as credit, available for new Orders. It is returned to the same funding source it was paid from — the part paid from Deposited Funds returns as Deposited Funds, the part paid from Promotional Credit returns as Promotional Credit. The delivered portion is Completed and final.

Canceled orders. If an Order is Canceled, the full amount is returned to your Balance as credit, to the same funding sources it was paid from (Deposited Funds and Promotional Credit in the same proportions). A refund or cancellation never converts Promotional Credit into Deposited Funds.

Stalled orders. An estimated start or delivery time is not a guarantee, and an Order being slow is not grounds for a refund (see Order Accuracy). Where an Order cannot be completed for reasons on our side or the tool becoming unavailable, it is resolved as Canceled or Partial and the corresponding amount is returned to your Deposited Funds. Where an Order cannot be completed because of how you placed it — a wrong, private, removed, or changed target — that is your responsibility under Order Accuracy and does not entitle you to a refund, though support may cancel it at its discretion.

10Refill & Guarantee

Most tools do not include a refill. Where a refill is offered, it is shown on that specific tool (in its name or description) and applies only while that tool's refill option is active.

  • A refill is not a guarantee. Like the tool itself, a refill is provided on a best-effort, conditional basis. Offering a refill on a tool does not promise that Drops will be fully or permanently restored.
  • Only a tool explicitly marked "Guarantee" carries a commitment from us. Any tool without that explicit label — including tools that offer a refill — is delivered as is, with no guaranteed outcome.
  • How refill is measured. Where available, refill is assessed per Order using the Order's own figures: Start Count plus ordered quantity equals the end count. A refill may apply only when the count has dropped below the end count while remaining at or above the Start Count, and is tied to the Order ID, not to the link.
  • What voids a refill. A refill does not apply if, after the Order, you change or remove the link, change your username, set the account or content to private, delete the content, or place overlapping Orders on the same link (see below). Drops from a base that existed before your Order are not covered.
  • Withdrawal of refill. A refill option may be changed, limited, or withdrawn at any time for future Orders. Refill timing, minimum drop thresholds, and coverage limits are those shown for the tool at order time.

11Order Accuracy & Your Responsibility

You are responsible for the details you submit with each Order. The following are not eligible for a refund, cancellation, or refill, as they result from how the Order was placed rather than from our delivery:

  • Wrong, non-working, or mistyped links. Confirm every Order before placing it. An Order placed on an incorrect link is your responsibility. Where our system can detect a non-working link before delivery, the Order may be cancelled automatically and the amount returned to your Deposited Funds.
  • Private accounts or restricted content. If the target account is private, or the content is restricted or removed so delivery cannot complete, the Order will not qualify for a refund.
  • Links changed after ordering. Changing the link, username, or privacy setting after placing an Order is your responsibility and voids any claim or refill on that Order.
  • Overlapping Orders on the same link. Do not run more than one Order on the same link at the same time — whether two Orders with us, or one with us and one elsewhere. When Orders overlap, the Start Count and Drops cannot be tracked reliably, and claims arising from overlap will not be accepted. Wait until one Order is Completed before placing another on the same link.
  • Existing base count. If you place an Order for a small quantity onto an account that already has a large existing count, natural movement of the pre-existing figures is not a Drop on your Order and is not covered.

Delivery time. Estimated delivery or start times shown for a tool are estimates, not guarantees. An Order being slow is not grounds for a refund; an Order in an active status is governed by the Order finality rule. How a stalled or unfulfillable Order is resolved is set out under Orders, Payment & Balance.

12Promotions & Credit

  • Promo codes and Promotional Credit are optional, time-limited, and may be modified, restricted, or discontinued at any time without prior notice.
  • Promotional Credit has no cash value, cannot be withdrawn or refunded, and is tracked separately from your Deposited Funds within the same Balance. It may carry its own expiration or conditions, shown at the time of redemption.
  • A promo code's specific terms (validity window, eligible accounts, minimum deposit, etc.) are those displayed at the time of redemption.
  • Using promo codes across multiple accounts to claim a benefit intended for a single user, or otherwise abusing a promotion, violates these Terms and may result in forfeiture of the related Promotional Credit and further action under Account Suspension & Termination.

13Refunds

This section covers refunds to a payment method, requested through support. It does not cover the automatic return of unused funds to your Balance for Canceled or Partial Orders — that is handled automatically under Orders, Payment & Balance and is not a "refund" in the sense of this section.

Refunds to a payment method are handled on a discretionary, case-by-case basis. We do not guarantee them. There is no fixed list of qualifying circumstances — each request is reviewed individually by our support team via a support ticket, and the decision is at our sole discretion.

Where such a refund is granted, the default method is a credit to your Balance as Deposited Funds, available immediately for new Orders. A refund to your original payment method is the exception, granted at our discretion and only where that payment method and our payment processor support it.

A refund to your payment method is reduced by:

  • Any non-refundable fees charged by our payment processor on the original deposit (we do not control or receive these), and
  • The total Promotional Credit ever granted to the account over its lifetime that has not already been deducted or otherwise reversed.

The refunded amount reflects only your Deposited Funds and never exceeds what you actually paid in and have not yet spent. The Promotional Credit deduction never reduces the figure below zero — if it mathematically would, it is treated as zero, and we do not create or leave a negative Balance through a refund. Before processing a refund that is materially reduced by these deductions, we will show you the final amount and confirm that you wish to proceed, so you can choose to keep the Balance instead.

Submitting a refund request does not guarantee one will be issued. A request raised after the Claim Window (Section 7) has passed will not be considered, even where a refund might otherwise have been reviewed.

14Withdrawals

You may request a withdrawal of unused funds from your Deposited Funds, subject to the following:

  • Withdrawals are returned to the original payment method used for the deposit, where supported by that method and our payment processor.
  • A withdrawal processing fee applies to each withdrawal, reflecting our actual costs of handling the withdrawal itself (payment-out, currency conversion, and processing). This fee does not exceed 10% of the amount withdrawn; the exact rate in effect is shown at the time you request the withdrawal.
  • Separately, any non-refundable fee that our payment processor charged on the original deposit is also deducted, where it was not already accounted for. These are distinct from the withdrawal processing fee above; we do not control or receive the deposit fee and cannot reimburse it.
  • Promotional Credit has no cash value and cannot be withdrawn.
  • A withdrawal request is cancelled if you place an Order from your Deposited Funds while the request is pending. Any non-refundable processing fee already applied to that request is not returned.
  • We may apply verification (see Verification & Fraud Prevention) before processing a withdrawal. Once we send funds through our payment gateway, the time to reach your account depends on your bank or payment provider.

15Closing Your Account

You may close your account at any time by contacting support. On closure, any remaining Deposited Funds may be withdrawn under the Withdrawals section (including its processing fee and verification), and any Promotional Credit is forfeited. We may decline to release a Balance where verification is incomplete or where there is an unresolved dispute, chargeback, or suspected violation of these Terms.

16Negative Balance

If your Balance becomes negative — for example, due to a reversed payment, a chargeback, a correction of an error, or a clawback of affiliate or Promotional Credit — you are responsible for the negative amount. We may recover it from future deposits or credits to your account, or invoice you for it.

17Chargebacks Prohibited

Initiating a chargeback, payment dispute, or reversal with your bank or payment provider instead of contacting us first is a violation of these Terms. If you initiate a chargeback:

  • We may immediately suspend or permanently ban your account, forfeit any positive Deposited Funds on it and cancel any Promotional Credit, and treat any resulting negative Balance under the Negative Balance section.
  • We reserve the right to invoice you for costs, fees, and damages arising from the chargeback (including processor chargeback fees and any losses incurred), and to pursue collection of that amount.

If you have a payment issue, contact us via a support ticket or billing@mail.smmpanelus.com before involving your bank or payment provider.

18Verification & Fraud Prevention

We may request verification of your identity or payment method before processing an Order, a payout, or a balance restoration request — particularly for large transactions or where we have a good-faith concern about fraud. We may suspend an Order, payout, or account pending verification, and we are not obligated to complete a transaction until verification is satisfactorily provided.

19Acceptable Use

Your use of the Service is governed by our Acceptable Use Policy, which forms part of these Terms and sets out the content and conduct that are not permitted — including unlawful use, harm to third parties, technical abuse, account and payment abuse, spam, and misuse of promotions or the affiliate program. You agree to comply with the Acceptable Use Policy in full.

A breach of the Acceptable Use Policy is a breach of these Terms. We may suspend or terminate an account that breaches it, at our discretion, with or without prior notice depending on severity, and may apply the enforcement set out in that Policy and these Terms. Where the Acceptable Use Policy is not yet published, this section and the rest of these Terms govern, and you must still use the Service lawfully and without harming others, infringing rights, or abusing the Service.

20Your Content & Representations

For each Order you place, you represent that:

  • You have the necessary rights or authorization to direct tools toward the link, page, or account you provide.
  • The content or page you are promoting does not infringe the intellectual property, privacy, or other rights of any third party, and is not itself content prohibited under these Terms.

We do not review or pre-screen links or content before processing an Order, and we rely on these representations in providing the Service to you. Not pre-screening does not waive our right to review an Order or account after the fact and to act on a violation under these Terms.

21API Access

Where we provide API access to the Service:

  • You are solely responsible for the security and confidentiality of your API key. Activity performed using your API key is treated as your own.
  • API use is subject to the rate limits and technical requirements published in our API documentation, which may change from time to time.
  • We may suspend or revoke API access for activity that places excessive load on our infrastructure, attempts to circumvent rate limits, or otherwise breaches the Acceptable Use Policy or these Terms.

22Intellectual Property

The Service, including the Site, its design, branding (including the SmmPanelUS name and marks), and underlying software, is the property of the Operator or its licensors and is protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

23Use of Third-Party Platform Names

We refer to third-party platforms by their names (for example, naming a platform a tool is intended for) to describe, truthfully and accurately, what a tool does. This is a referential, descriptive use of a name to identify the platform a tool is meant to work with — it is not a claim of any relationship with that platform.

  • Names, not marks. We use the plain word name of a platform only as far as is needed to identify it. We do not reproduce or display a platform's logos, stylized marks, brand colors, or other protected brand assets, and we do not use any platform's marks in a way that suggests we are that platform or are endorsed by it.
  • No affiliation or endorsement. We are not affiliated with, authorized by, sponsored by, partnered with, or endorsed by any platform we name. Naming a platform does not imply any of these.
  • Legal basis. This referential use of a name is recognized under applicable law as a legitimate, non-infringing use — for example, the principle of referential ("nominative") fair use and the descriptive use of a name, under which a party may use another's name to identify that other's goods, services, or platform, provided the use is truthful, is limited to what is reasonably necessary to identify it, does not use the other's protected marks beyond the name, and does not suggest sponsorship or endorsement. We rely on this principle, and on equivalent provisions of applicable trademark law, when we name a platform.
  • Rights remain with the owners. All third-party names and marks remain the property of their respective owners. Nothing in these Terms transfers any right in them to you, and your use of any tool does not grant you any right to use a platform's name or marks.
  • Acting on a concern. If a rights holder believes a specific reference exceeds legitimate referential use, they may contact us at legal@mail.smmpanelus.com, and we will review the specific reference in good faith.

24Service Availability

We aim to keep the Service available and publish live status and uptime figures as an honest reflection of operation, not as a contractual promise. The Service may be interrupted for planned or emergency maintenance, or by causes outside our reasonable control. We do not guarantee that the Service will be uninterrupted or available at any specific time, and live status figures do not create any uptime guarantee or service-credit entitlement.

25Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY TOOL WILL PRODUCE A PARTICULAR RESULT ON A THIRD-PARTY PLATFORM.

26Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR (WHICH OPERATES SMMPANELUS) AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

27Indemnification

You agree to indemnify, defend, and hold harmless the Operator (which operates SmmPanelUS) and its officers, employees, and affiliates from any claim, demand, loss, or liability (including reasonable legal fees) arising out of: (a) your use of the Service; (b) the content or link you submitted for an Order; (c) your violation of these Terms or any applicable law; or (d) your violation of any right of a third party, including intellectual property or privacy rights.

28Account Suspension & Termination

We may suspend or terminate your account, with or without notice, if you violate these Terms, engage in fraudulent or abusive behavior, initiate a chargeback, or for any other reason at our discretion. You may stop using the Service and close your account at any time by contacting support.

Termination does not entitle you to a refund of any remaining Balance except where required by these Terms or applicable law.

29Sanctions & Restricted Regions

We may restrict, suspend, or decline to provide the Service to any person, account, or region where we have a good-faith basis to believe this is necessary to comply with sanctions, export control, or similar restrictions applicable to us. By using the Service, you represent that your use does not violate any sanctions or trade restrictions applicable to you.

30Dormant Accounts & Balance

An account is considered inactive if it has no login, deposit, or Order activity for 12 consecutive months.

  • Freeze. After 12 months of inactivity, the Balance is frozen. If your email address is verified, we will attempt to notify you 14 days before the freeze takes effect. We do not send notifications to unverified email addresses.
  • Standard balances (Deposited Funds under $1,000, as measured at the freeze). 6 months after the freeze, the remaining Deposited Funds are forfeited in full, with no further right to restoration. If your email address is verified, we will attempt to notify you 14 days before forfeiture. Restoration after forfeiture is not guaranteed and may only be granted at our sole discretion as a goodwill exception.
  • Larger balances (Deposited Funds of $1,000 or more, as measured at the freeze). You retain the right to request restoration for 18 months from the date of the freeze. If no request is made within that window, the Deposited Funds are forfeited in full with no further right to restoration.
  • Promotional Credit is forfeited at the freeze point in all cases, regardless of the Deposited Funds threshold, and is never eligible for restoration.
  • You are responsible for verifying and keeping your registered email address current. We only send dormancy notifications to verified addresses; an unverified or outdated email does not extend any deadline in this section. Our notification obligation, where applicable, is satisfied once the email is sent from our systems — we are not responsible for non-delivery caused by a full inbox, spam filtering, or your email provider.

To request restoration, open a support ticket from your account or contact support@mail.smmpanelus.com.

A freeze or forfeiture under this section does not cancel any negative Balance or amount you owe us; the Negative Balance section continues to apply.

31Changes to These Terms

We may update these Terms from time to time. Any change is reflected by an updated "Last updated" date on the published Terms; for material changes we may also provide notice. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

32Resolving Disputes

If you have a concern or dispute, contact us first via a support ticket (10:00–23:00 SGT) or legal@mail.smmpanelus.com. We will make a good-faith effort to resolve the matter directly before any other steps are taken.

These Terms are governed by applicable law. Nothing in this section limits any non-waivable rights you may have under the law applicable to you.

33Contact

We aim to acknowledge written/email legal notices within 5 business days and provide a substantive response within 30 calendar days. Support tickets are answered within our support hours (10:00–23:00 SGT).

34Entity & Compliance

The Operator is the legal entity that operates the Service and is the party to these Terms. Its name, registration, and address are not published on the storefront. These details, together with any compliance or KYB documentation, are provided only on request to a legitimate party — for example, a payment processor, a regulator, or a party with a verified legal claim — and are never published publicly.

35Related Policies

These Terms incorporate by reference any Acceptable Use Policy, Privacy Policy, and other policies we publish for the Service. If and when published, each such policy forms part of your agreement with us and is enforced as part of these Terms; a breach of any such policy is a breach of these Terms. To the extent a topic is not yet covered by a separate policy, the relevant provisions of these Terms govern. If a published policy and these Terms conflict, these Terms prevail unless that policy expressly states otherwise for the specific point.

36Force Majeure

We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to outages of third-party platforms, payment processors, hosting or network providers, internet infrastructure failures, acts of government, or other events outside our control.

37No Waiver; Assignment

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms at our discretion.

38Electronic Communications

By using the Service, you consent to receive communications from us electronically, including through support tickets, in-account notices, and email where applicable. You agree that such electronic communications satisfy any legal requirement that communications be in writing.

Notices to you. We may send you notices through in-account messages, support tickets, or your verified email. A notice is treated as received when sent through any of these channels.

Third-party payment terms. Payments are processed by third-party payment providers and are also subject to their terms. We are not responsible for their fees, delays, holds, declines, or service interruptions.

No professional advice. The Service and its tools are not marketing, financial, legal, or other professional advice. Decisions you make using the Service are your own.

Your taxes. You are solely responsible for any taxes arising from your use of the Service, including as a reseller.

39Survivability

Sections that by their nature should survive termination of your account or these Terms — including Your Content & Representations, Intellectual Property, Indemnification, Disclaimers, Limitation of Liability, Negative Balance, Chargebacks Prohibited, Resolving Disputes, and any provision concerning amounts owed — remain in effect after termination.

40Interpretation

Section headings and labels are for convenience only and do not affect the interpretation of these Terms. Throughout these Terms, a reference to a feature, page, status, document, amount, or contact address is identified by its function and logic, not by an exact name match: if the Service or any communication uses a different word, label, spelling, abbreviation, or translation for the same thing, these Terms still apply to it. "Including" and "for example" introduce illustrative, non-exhaustive lists. No provision is rendered inapplicable by a difference in naming alone; where wording is genuinely ambiguous, it is read in the way most consistent with the rest of these Terms.

41Entire Agreement; Severability

These Terms constitute the entire agreement between you and the Operator (which operates SmmPanelUS) regarding the Service and supersede any prior agreements. If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent, and the remaining provisions will remain in full effect.

1Status of This Policy

This Acceptable Use Policy ("AUP," "Policy") is part of, and incorporated by reference into, the SmmPanelUS Terms of Service ("Terms"). It is not a separate or standalone agreement: it is enforced as part of the Terms, and the Terms govern it, including their provisions on liability, indemnification, suspension, balances, and dispute resolution. Capitalized terms used here have the meaning given in the Terms, and "we," "us," and "our" mean the Operator, as defined in the Terms. By accepting the Terms or using the Service, you agree to this Policy. A breach of this Policy is a breach of the Terms and may lead to the enforcement actions in Section 5 and to any remedy available to us under the Terms.

The interpretation rule in the Terms applies here too: this Policy is read by its function and logic, not by an exact name match, and the listed examples are illustrative, not exhaustive.

2Your Responsibility

You alone are responsible for the targets, links, content, and quantities you choose, and for ensuring your use of the Service is lawful in your jurisdiction and consistent with the rules of the third-party platforms you direct tools toward. We do not pre-screen Orders. Not pre-screening does not waive our right to review an Order or account and to act on a breach.

Where this Policy is silent on a specific case, you remain bound by the general duty not to use the Service unlawfully, deceptively, or to harm others.

Substance over form. This Policy is judged by the purpose and effect of conduct, not only by whether an act is named in a list. If an act is not listed but its aim or result is unlawful, deceptive, harmful, or designed to evade these rules, we may treat it as a breach. Deliberate attempts to find a loophole are themselves a breach.

3Prohibited Content

You may not use the Service in connection with content, pages, accounts, or links that involve any of the following. This list is illustrative, not exhaustive. We do not support or facilitate the infringement of any third party's rights, and we prohibit using the Service to do so.

3.1. Serious crime and exploitation.

  • Terrorism, violent extremism, or organized crime, or material that finances, promotes, or recruits for them.
  • Child sexual abuse material (CSAM) in any form, including drawn, simulated, or AI-generated material.
  • Any content that sexualizes a minor, or that targets, endangers, or exploits a minor, even where it does not meet the threshold of CSAM.
  • Human trafficking, sexual exploitation, or any non-consensual sexual content, including intimate content shared without the proven, current consent of everyone depicted ("revenge" content).
  • Trade in weapons, explosives, controlled drugs, human organs, stolen goods, or protected wildlife.

3.2. Fraud and financial crime.

  • Financial pyramids, Ponzi or "HYIP" schemes, and any promise of guaranteed or unrealistic returns.
  • Phishing, fake or spoofed sites, credential theft, carding, money laundering, or sale of fraudulent documents or payment instruments.
  • Sale of goods or services that do not exist, fake fundraising, or other deception.

3.3. Hate, harassment, and harm to people.

  • Incitement to violence, hatred, or discrimination against a person or group on the basis of a protected characteristic.
  • Targeted harassment, doxxing, stalking, or content that encourages self-harm or suicide.

3.4. Infringement and privacy.

  • Infringement of copyright, trademark, or other intellectual property rights, including promotion of counterfeit goods or pirated material.
  • Publishing or promoting another person's private information or media without their consent.

3.5. Serious deception and manipulation.

  • Disinformation that can endanger health, public safety, or critical infrastructure.
  • Content aimed at undermining democratic processes, such as voter suppression or false information about candidates or elections.
  • Deepfakes, fake news outlets, or coordinated inauthentic behavior used to deceive.
  • Impersonation of a person, brand, or authority for deceptive or fraudulent purposes.

3.6. Regulated and restricted goods.

  • Promotion of regulated or restricted goods and services — for example, prescription pharmaceuticals, tobacco or vaping products, weapons, or gambling — where doing so is unlawful in the applicable jurisdiction.
  • Academic-fraud services, such as the sale of essays, dissertations, or exam-taking.

You are responsible for ensuring any content you promote is lawful in the jurisdictions that apply to you and complies with the rules of the third-party platform involved.

4Prohibited Conduct

Independently of the content involved, the following conduct is prohibited.

4.1. Harm third parties through the Service. We do not support or facilitate the use of any tool to harm a third party. You may not use any tool — including tools that send negative signals — to harm, attack, suppress, or unfairly compete against a third party. You may direct tools only at targets you own or have explicit written permission to act on; directing tools at any resource you neither control nor have written permission to act on is prohibited. Using the Service to damage competitors, public figures, brands, or any person you do not control is prohibited, and you carry full responsibility for such use.

4.2. Abuse the platform technically. You may not probe, scan, reverse-engineer, or attempt unauthorized access to the Service, its infrastructure, or other accounts; place excessive load on the infrastructure or exceed published API limits in a way that affects others; use bots or scrapers to register accounts, mass-place Orders, or harvest data without our written permission; or transmit malware or malicious links through any field, Order, or ticket.

4.3. Spam and unsolicited messaging. You may not use the Service, or an account or tool obtained through it, to send spam or unsolicited bulk or commercial messages, or to support such activity.

4.4. Abuse accounts and payments. You may not use stolen, fake, or unauthorized payment details; abuse the refund, withdrawal, or promotional mechanics through false information or manipulation; initiate a chargeback in breach of the Terms; sell, rent, or transfer your account without our written consent; or breach the Multi-Account Policy.

4.5. Abuse the affiliate program. Where you take part in the affiliate or referral program, you may not register under your own referral link or use accounts you own or control to claim referral rewards (self-referrals); use cookie-stuffing, hidden frames, forced clicks, or other deceptive techniques to attribute referrals; bid on or run paid advertising against our brand names; or otherwise inflate referral activity by artificial means.

4.6. Misuse third-party platforms. You acknowledge that many platforms restrict artificial changes to metrics. Compliance with the rules of any platform you direct tools toward is your responsibility, and you accept the risks of doing so as set out in the Terms.

4.7. Resellers and child panels. If you resell access or run a child panel built on our API, you are responsible for ensuring that all traffic routed through your account complies with this Policy, including the activity of your own end customers. A breach originating from your downstream customers is treated as your breach.

4.8. Sanctions and restrictions. You may not use the Service in a way that breaches the Sanctions & Restricted Regions provisions of the Terms or any sanctions or trade restrictions applicable to you.

5Our Rights and Enforcement

5.1. We decide what breaches this Policy. We determine, at our sole discretion and on the information available to us, whether conduct breaches this Policy. Our decision is final, except where applicable law provides otherwise.

5.2. Monitoring and investigation. We may review Orders and accounts, on a routine or targeted basis or in response to a report, and may suspend an account together with all of its active Orders pending investigation, without prior notice. We may preserve relevant account data, Orders, and Balance as evidence for the duration of an investigation or dispute. We are not obligated to disclose the details, methods, or results of an investigation.

5.3. Enforcement. Depending on the severity of the breach, we may, alone or in combination and at our discretion: reject or cancel the affected Order; issue a warning; suspend or permanently terminate the account; block access by identifier (such as payment method or other unique data); and forfeit any positive Deposited Funds as set out in the Terms. Promotional Credit, which has no cash value, is cancelled in any case of abuse and is not part of the liquidated-damages calculation below.

5.4. Forfeited funds as liquidated damages. Where a breach leads to suspension or termination and forfeiture of Deposited Funds, the forfeited amount is treated as liquidated damages — a reasonable pre-estimate of the costs the breach causes us, including administrative and investigation costs, reputational harm, and potential penalties from payment providers. It is not a penalty. A breach that leads to suspension or termination is a material breach of the Terms and ends any obligation to refund a Balance, to the extent permitted by the Terms and applicable law.

5.5. Cooperation. We may cooperate with law enforcement, regulators, payment providers, and affected parties where there is a valid and lawful basis, and may provide the information available to us for that purpose. How we handle personal data, including such disclosures, is described in our Privacy Policy.

5.6. Serious harm — reporting without notice. For the most serious breaches — including child sexual abuse material, the exploitation or endangerment of a minor, terrorism, or an imminent threat to life — we treat the matter with the utmost seriousness and apply the same firm approach to all such cases. We may report the activity and disclose the information available to us to law enforcement or the relevant authorities without notifying you, and we may do so before, during, or instead of any internal process. Nothing in this Policy or the Terms requires us to warn you, to wait, or to give you an opportunity to respond before acting in such cases.

6Reporting a Violation

If you believe content or activity breaches this Policy, report it through a support ticket or to abuse@mail.smmpanelus.com. To help us act, include the specific link or Order reference and a clear description of the issue, with any evidence.

1About This Policy

This Privacy Policy explains what personal data we collect when you use SmmPanelUS (the "Service," "Site"), available at smmpanelus.com, why we collect it, how we handle it, and the rights you have over it. It is part of, and incorporated by reference into, our Terms of Service ("Terms"). Capitalized terms have the meaning given in the Terms, and "we," "us," and "our" mean the Operator, as defined in the Terms.

We follow one guiding principle: we collect the minimum data the Service needs to work, and nothing more. We do not sell your personal data, and we do not use third-party advertising or analytics trackers.

2The Platform We Run On

The Service runs on the Perfect Panel platform — a specialized platform for this type of service — and is served over an encrypted (HTTPS/SSL) connection. Because the Service operates on Perfect Panel's infrastructure, your account data and Order data are stored and processed within that infrastructure as part of running the Service. The platform provider acts as our processor for that hosting and processing and handles the data to operate the Service on our behalf, not for its own purposes.

3Data We Collect

We collect only the following.

3.1. Data you provide directly.

  • Email address — for your account, sign-in, security, and service notices.
  • Login (username) — the identifier for your account.
  • Screenshots or attachments — only if you choose to send them to us, for example in a support ticket. We do not collect these otherwise.
  • Order details — the links or targets you submit with an Order, and the parameters you choose. We store these as part of providing and supporting the Service.

3.2. Data we collect automatically.

  • IP address — recorded for security, fraud prevention, and to operate and protect the Service.
  • Country — determined from your IP address. We do not collect precise location.
  • Basic usage data — through our own internal statistics only (see Analytics).

3.3. Payment data. Payments are handled by third-party payment processors. Card numbers and full payment credentials are entered with and processed by those processors — we do not collect or store your card numbers. We may receive limited transaction information from a processor (such as whether a payment succeeded) to manage your Balance and Orders.

4Data We Do Not Store

To be clear about what we deliberately do not keep:

  • Passwords are not stored in readable form. We do not keep your password as plain text and cannot see or retrieve it. If you lose access, a password can only be reset (reissued), never recovered.
  • API keys are encrypted and shown once. Your API key is stored in encrypted form and is not viewable again after it is issued. If you need a new one, it can only be regenerated, not re-displayed.
  • Card numbers are not stored — see Payment data above.

5Analytics — Our Own, No Third Parties

We use our own internal statistics to understand and improve the Service. We do not use Google Analytics or any other third-party analytics or advertising service, and we do not allow third-party trackers to profile you across other sites.

Our internal statistics are limited to:

  • the number of registrations;
  • the number of sign-ins;
  • whether a user is new or returning;
  • IP address;
  • pages visited on the Site;
  • country (determined from IP).

That is the full extent of our internal usage statistics. (Other data we collect, and why, is set out in Data We Collect; this section covers only our internal statistics.)

6Why We Use Your Data

We use the data above only to:

  • create and operate your account and provide the Service;
  • process and support your Orders, and manage your Balance;
  • keep the Service secure — prevent fraud, abuse, and unauthorized access;
  • respond to your support tickets;
  • send essential service and security notices;
  • understand and improve the Service through our own internal statistics;
  • meet legal, accounting, and regulatory obligations.

We process your data on the bases recognized by applicable law, including performance of our contract with you (the Terms), our legitimate interests in operating and securing the Service, your consent where required, and compliance with our legal obligations.

7When We Share Data

We do not sell your personal data. We share it only where necessary:

  • Payment processors — to process your payments (they act under their own privacy terms).
  • The platform/hosting provider — as our processor, to run the Service (see The Platform We Run On).
  • Legal and safety — where we have a valid and lawful basis: to comply with law, respond to a lawful request, enforce the Terms or Acceptable Use Policy, or protect the rights, safety, and property of any person. For the most serious matters — such as child sexual abuse material, the exploitation or endangerment of a minor, terrorism, or an imminent threat to life — we may disclose data to law enforcement or the relevant authorities without notifying you, as set out in the Acceptable Use Policy.

We do not otherwise share your personal data with third parties for their own purposes.

8How Long We Keep Data

We keep your personal data for as long as your account is active and for a reasonable period afterward — long enough to meet legal, accounting, regulatory, and dispute-resolution requirements, and to protect against fraud and abuse. When data is no longer needed for these purposes, we delete it or render it anonymous. Note that the dormancy and balance rules in the Terms (Dormant Accounts & Balance) may apply to your account separately.

9Security

We protect your data with technical and organizational measures appropriate to the Service: an encrypted (HTTPS/SSL) connection, hashing of passwords so they are never stored in readable form, encryption of API keys, and access controls. No method of transmission or storage is completely secure, and we cannot promise absolute security, but we work to keep your data protected and to limit who can access it.

10Your Rights

Subject to applicable law, you have rights over your personal data. Depending on where you are, these include:

  • Access — ask what personal data we hold about you.
  • Correction — ask us to correct inaccurate data.
  • Deletion — ask us to delete your data ("right to erasure"), subject to data we must keep for legal, accounting, or fraud-prevention reasons.
  • Restriction and objection — ask us to limit or stop certain processing.
  • Portability — ask for a copy of certain data in a portable form.
  • Withdraw consent — where we rely on consent, withdraw it at any time.

If you are in the EU/UK (GDPR). You have the rights above as data subject. We process your data on the lawful bases described in this Policy. You also have the right to lodge a complaint with your local data protection authority.

If you are in California (CCPA/CPRA). You have the right to know what personal information we collect and how we use it, the right to request deletion, and the right to opt out of the "sale" or "sharing" of personal information. We do not sell or share your personal information in the way those laws define it. Sharing data with a payment processor or our platform provider so they can perform a service for us is not a "sale" or "share" in that sense — they act on our instructions, not for their own purposes. We do not discriminate against you for exercising your rights.

To exercise any right, open a support ticket from your account or contact privacy@mail.smmpanelus.com. We may need to verify your identity before acting, and we will respond within the time required by applicable law.

11Children

The Service is not directed to children, and you must be at least 18 to use it (see the Terms). We do not knowingly collect personal data from anyone under 18. If we learn that we have collected data from a person under 18, we delete it. This does not limit the steps we may take in cases of serious harm to a minor, such as child sexual abuse material, which are handled as set out in When We Share Data and the Acceptable Use Policy.

12International Transfers

The Service is available internationally, and your data may be processed in countries other than your own. Where data is transferred across borders, we rely on the safeguards recognized by applicable law for such transfers.
